Information obligations under the Basic Data Protection Regulation (DSGVO)

Provision of our services in accordance with the articles of association and business

We process the data of our members, supporters, interested parties, customers or other persons in accordance with Art. 6 DSGVO, insofar as we offer contractual services to them or act within the framework of existing business relationships, e.g. to members, or are ourselves recipients of services and benefits. Otherwise, we process the data of affected persons on the basis of legitimate interests, e.g. if administrative tasks or public relations work are involved.

This basically includes inventory and master data of the persons (e.g., name, address, etc.), as well as contact data (e.g., e-mail address, telephone, etc.), contract data (e.g., services used, contents and information provided, names of contact persons) and, if we offer services or products that are subject to payment, payment data (e.g., bank details, payment history, etc.).

We delete data that is no longer required for the provision of our statutory and business purposes. This is determined according to the respective tasks and contractual relationships. In the case of business processing, we retain the data for as long as they may be relevant to the business transaction and also with regard to any warranty or liability obligations. The necessity of storing the data is reviewed every three years; otherwise the statutory storage obligations apply.

3. purpose of data processing; legal basis

The BSW processes personal data for the communicative promotion of the association’s purpose according to § 2 of the statutes.

The processing is carried out on the basis of the consent of the persons concerned (cf. Art. 6 para. 1 number a DSGVO) or because

is necessary for the performance of a contract with the persons concerned or for the implementation of pre-contractual measures taken at the request of the persons concerned (cf. Art. 6 para. 1 letter b DSGVO)
is necessary to safeguard the legitimate interests of the BSW or of a third party, unless such interests or fundamental rights or freedoms of the data subjects require the protection of personal data (cf. Art. 6 para. 1 letter f DSGVO)
is permitted under other legislation.

The BSW has a justified interest in promoting the purpose of the association. Legitimate interests of third parties are mainly those of the members of the BSW, those of persons and companies from the solar and storage industry, those of actors from politics, economy and society and of consumers, to be informed about the expansion, development, progress and promotion instruments of solar energy, to network this energy industry and technology and those directly and indirectly involved and interested in this energy industry and technology with each other and to promote and use the development in this area of energy industry and technology in a macroeconomic, political, social and consumption-oriented manner.

Especially names, companies or other designations of natural and legal persons and their contact details. (such as address addresses, telephone and fax numbers and e-mail addresses etc.), data required for the processing of payment services (such as bank and account data etc.), data required for payroll accounting and other personal data serving the processing purpose according to No. 3.

The categories of recipients with whom the BSW communicates in order to promote the purpose of the processing using the personal data are the interested persons listed under No. 3.

The BSW cooperates with contract processors to process such communications and, if necessary, transfers personal data to them for this purpose. In doing so, the processors are subject to the instructions of the BSW regarding the manner in which these data are processed and are obliged to delete these data once the purpose of the communication has been achieved or on the instructions of the BSW.

6. duration of storage

The BSW only stores personal data for as long as the consent of the persons concerned has been obtained or as long as this is necessary to fulfil the processing purpose in accordance with No. 3. If these conditions are no longer met, the BSW will delete such data.

7. rights of the data subjects

Data subjects affected by the processing of their personal data may have rights of access to personal data concerning them, rectification, erasure, restriction of processing and transferability.

8. right to withdraw consent; right of objection

If the persons concerned have consented to the processing of their personal data by the BSW, they have the right to withdraw their consent at any time.

If the processing is carried out in the overriding interest of the BSW (cf. Art. 6 para. 1 number f DSGVO), they also have the right to object to this processing for reasons arising from a special situation of the data subjects.

9. right of appeal to the supervisory authority

Data subjects have the right to complain to a data protection supervisory authority if they believe that the processing of personal data concerning them is in breach of the DPA.

The BSW processes personal data primarily from publicly accessible sources, in particular from directories in which information about companies or persons is made public by them either voluntarily or on the basis of legal provisions, such as imprints on Internet pages or social networks, or because the BSW has been informed of such information by the persons concerned for the purpose of communication, in particular in connection with business, political or otherwise public-related communication with companies or persons, such as electronic, postal or personal (business cards) communication, unless this is done expressly or recognisably for purely private purposes.

Data entered into the fields of our contact forms under the sub-domains www.solarwirtschaft.de/service-navigation/kontakt.html and www.solarwirtschaft.de/presse/presseverteiler.html will be transmitted only to us and only in the event and used by us under the circumstances mentioned in the above paragraphs 1. to 10. if the person entering the data has given his or her prior consent to such transmission and use by clicking the box provided there.

12. cookies

The programs that display our Internet pages via the domain www.solarwirtschaft.de and its sub-domains when you visit them via a web browser and that are stored on our web server (our Internet pages) use so-called cookies.

These are files that can place and exchange information in the relationship between our Internet pages or our web server and the visitor’s web browser.

Our Internet pages use cookies of the open-source analysis software of the provider Matomo (formerly PIWIK). The data collected in the process are mainly the time and duration of the visit, the domains and sub-domains visited, the browsers used and the IP addresses of the devices used for the visit, whereby the IP addresses are anonymised before being saved. These data cannot be used to establish any reference to persons, even in connection with further information. The data will not be passed on to third parties. You can prevent the storage of cookies by adjusting your web browser settings; however, we would like to point out that in this case you may not be able to use all the functions of our website to their full extent.

Our web server of domainfactory GmbH, Oskar-Messter-Straße. 33, 85737 Ismaning uses cookies with which so-called server log files are generated, i.e. files containing information that is exchanged during communication between the visitor’s web browser and our web server when visiting our internet pages. They correspond to the data collected by the cookie from Matomo. Whereby the IP addresses are completely collected by our web server to our knowledge and insofar a personal reference could be established in principle. However, this data collection is carried out without our initiative and will and without our influence.

13. newsletter data

To send our newsletter we need an e-mail address from you. A verification of the given e-mail address is necessary and you have to agree to receive the newsletter. Additional data is not collected or is voluntary. The data will be used exclusively for sending the newsletter.

The data provided when registering for the newsletter will be processed exclusively on the basis of your consent (Art. 6 para. 1 lit. a DSGVO). A revocation of your already given consent is possible at any time. To revoke your consent, simply send us an informal e-mail or unsubscribe using the “Unsubscribe” link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

Data entered to set up the subscription will be deleted in case of cancellation. If these data have been transmitted to us for other purposes and elsewhere, they will remain with us.

14. twitter / x

Functions of the Twitter / x service are integrated on our pages. These functions are offered by Twitter Inc, 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. By using Twitter / x and the “Re-Post” function, the websites you visit are linked to your Twitter / x account and made known to other users. Data is also transferred to Twitter / x. We would like to point out that we, as the provider of the sites, have no knowledge of the content of the transmitted data or its use by Twitter. 15. linkedIn

Our website uses features of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Each time you access one of our pages that contains LinkedIn features, a connection to LinkedIn’s servers is established. LinkedIn is notified that you have visited our sites using your IP address. When you click on LinkedIn’s “Recommend” button and are logged into your LinkedIn account, LinkedIn is able to track your visit to our site to you and your account. We would like to point out that we, as the provider of these pages, have no knowledge of the content of the transmitted data or its use by LinkedIn.

16. OpenStreetMap

We integrate the maps of the “OpenStreetMap” service (https://www.openstreetmap.de), which are offered on the basis of the Open Data Commons Open Database License (ODbL) by the OpenStreetMap Foundation (OSMF). Privacy policy: https://wiki.openstreetmap.org/wiki/Privacy_Policy.

To the best of our knowledge, OpenStreetMap uses user data exclusively for the purpose of displaying map functions and temporarily storing the selected settings. This data may include, in particular, IP addresses and location data of the users, which, however, will not be collected without their consent (as a rule, this is carried out as part of the settings of their mobile devices).

17. google maps

In our internet presence we use Google Maps to show our location and to provide directions. This is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter only referred to as “Google”.

By being certified according to the EU-US Privacy Shield https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active, Google guarantees that the data protection requirements of the EU are also complied with when processing data in the USA.

In order to enable the display of certain fonts on our website, a connection to the Google server in the USA is established when our website is accessed.

If you call up the Google Maps component integrated into our website, Google will store a cookie on your end device via your Internet browser. In order to display our location and to create a route description, your user settings and data are processed. We cannot exclude the possibility that Google uses servers in the USA.

The legal basis is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in optimizing the functionality of our website.

Through the connection to Google established in this way, Google can determine from which website your enquiry has been sent and to which IP address the directions are to be sent.

If you do not agree with this processing, you have the possibility to prevent the installation of cookies by making the appropriate settings in your Internet browser. You will find details on this under the item “Cookies” above.

By means of the connection to Google established when you call up our website, Google can determine from which website your enquiry was sent and to which IP address the representation of the text is to be transmitted.

19. YouTube

For integration and display of video content our website uses plugins from YouTube. The provider of the video portal is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

When a page with integrated YouTube plugin is called up, a connection to the YouTube servers is established. This tells YouTube which of our pages you have visited.

YouTube can directly assign your surfing behavior to your personal profile, if you are logged in to your YouTube account. By logging out you have the possibility to prevent this.
